Assisted Housing Rulemaking Update

To date, there has been no formal update on the rulemaking for 10-144 CMR Ch. 113, Regulations Governing the Licensing and Functioning of Assisted Housing Programs. The proposed rules were released on October 23rd and a public hearing was held on November 13th. Written comments were due by November 25th. In addition to public hearing testimony, MHCA submitted extensive comments in strong opposition to the rule.

The Department indicated it is still working through the rulemaking process and is compiling all of the comments received (both oral testimony at the public hearing and written comments) and is in the process of drafting responses. The Department will then issue a Response to Comments document. If any revisions are made to the proposed rule in response to the comments received, they will share those in a redline document.

MHCA is working on next steps with advocacy efforts. Given that these are major substantive rules, the Legislature has to review and approve them so there will be additional opportunities for public comment.
