Important Update on Chapter 113, Assisted Housing Rules and Data Reporting Requirements

With the recent passage of LD 979, signed into law by the Governor, DHHS has almost completed its update to Chapter 113: Assisted Housing Programs Licensing Rule. The final rule is not yet in effect, and they expect to publish it within the next 6 weeks, and will provide notice.

As part of these updates, the Division of Licensing and Certification (DLC) will be required to collect specific staffing and census data from Assisted Housing facilities on a quarterly basis. The data required includes:
  1. Daily staffing numbers for each shift
  2. Use of temporary staff
  3. Staff turnover rates
  4. Daily resident census
Please note: This reporting requirement does not apply to currently-licensed Level 1-3 residential care facilities providing services to individuals with intellectual and developmental disabilities, autism, other related conditions, or acquired brain injury (often referred to as HCBS settings). A proposed licensing rule for those settings is forthcoming.

To comply with Chapter 113, facilities must complete and submit a quarterly survey. A draft version of the survey is available here (scroll to the bottom of the page). DLC encourages providers to review it so your facility can plan how and by whom this data will be collected starting this fall.

Starting October 1, 2025, Assisted Housing facilities must begin recording this data. The first submission to DLC, covering Q4 of 2025, will be due in January 2026 (and must include your data from October, November, and December 2025).
