Maine DHHS ends staffing ratio waiver

Yesterday the Maine DHHS Division of Licensing and Certification announced the end of the waiver of the state staffing to resident ratio and reminds member homes that a PSS will count as a direct care provider in LTC. 

Homes will no longer be able to request a waiver of the State's minimum staff to resident ratio effective February 7, 2022. Additionally, homes that have approved waiver will have 3 weeks from February 7th to return to compliance with the minimum ratio.

As a reminder, a PSS, CNA, LPN and RN are all considered direct care providers. This will allow a PSS to work within a SNF/NF within their scope of practice. A PSS is a short-40 hour course and you can view the curriculum from the DHHS website at
