No Surprise Act: Free Webinar on the new IDR process

CMS will host a webinar on Wednesday, April 27, 1:00 PM to 2:30 PM ET, for an in-depth session on the Independent Dispute Resolution (IDR) process for disputing parties (health care providers, emergency facilities, providers of air ambulance services, group health plans, health insurance issuers, and Federal Employees Health Benefits (FEHB) Carriers) and a demonstration of the IDR initiation webform and certified IDR entity selection form.

On April 15, 2022, the Departments of Health and Human Services, Labor, and the Treasury (the “Departments”) opened the Federal IDR portal for health care providers, emergency facilities, providers of air ambulance services, group health plans, health insurance issuers, and Federal Employees Health Benefits (FEHB) Carriers to initiate the Federal IDR process. The Departments announced that any party who had exhausted their open negotiation period before the launch of the portal, would be given 15 business days after the portal launch to initiate the process. Therefore, any parties whose open negotiation period ended prior to April 15th have until May 6th to initiate the process. If the open negotiation period ended on or after April 15th, then parties must initiate the process within 4 business days after the end of the open negotiation period. We will provide more details about how the IDR process works and demonstrate the various forms used in the IDR process during this webinar on April 27th.
